1. REACH AND ACCEPTANCE
   • The following Conditions of Use (throughout this document referred to as Conditions of Use) regulate the use of the website www.the-notebookclub.com (throughout this document referred to as the Site), responsibility of Soluciones Administrativas Kosheleva SA de CV. (throughout this document referred to as “The Notebook Club”), Mexican company based in Av. Antonio de Mendoza Número 323 Int: E, Colonia Lomas de Chapultepec IV Sección, CP 11000, Miguel Hidalgo, Ciudad de México, México, with the email address contacto@dinamcg.com
   • The Site’s use recognizes the User’s condition and expresses full and unreserved conformity for the User to every single one of the Conditions of Use, according to the published version in the moment of the User’s entrance to the Site. We advise the User to read the following Conditions of Use carefully. In case of contradiction between the Conditions of Use and the Particular Conditions that may be established, these last ones will prevail.
2. OBJECT
   • Through the Site, “The Notebook Club” facilitates the User’s access to diverse content displayed through the Site.
   • When entering the Site, the User accepts all Conditions of Use established by “The Notebook Club” and, therefore, is commanded to all of these Conditions of Use. The User accepts all Conditions of Use established by the Site. If these Conditions of Use are not satisfactory, please click on the I DO NOT ACCEPT button and abstain from entering the Site.
     • The User is legally capable and has the mental and physical faculties to decide, approve and use the Site under the following terms. The User manifests openly to accept these Conditions of Use. 
     • The User accepts to enter the Site under a completely autonomous will and full mental capability.
     • The Conditions of use are current in the moment when the User enters the Site and completes the registration.
     • The User is free to enter the Site as many times as he or she wishes, without being excluded by “The Notebook Club» unless the following conditions are violated.
     • Images, brands, symbols, sounds, names and/or any content included in the material published through the Site are understood as intelectual property with reserved rights. This material is exclusive property of “The Notebook Club”, which is acknowledged and accepted by the User.
     • “The Notebook Club” is not directly responsible for content published on the Site. The User accepts this and abstains to develop any retaliation against “The Notebook Club” in case any content infringes upon their moral integrity, political or religious beliefs, or personal convictions.
     • “The Notebook Club” withholds the right of admission and the autonomy of refusing, prohibiting or forbidding the entrance to the Site for any User due to the wrong, illegal use or conducts against the Conditions of Use listed above. In case of being vetoed, the User will accept the decision without complaints or rights of compensation.
   • “The Notebook Club”, through the registration process in the Site, provides information access in the following topics: (i) architecture, (ii) design, (iii) construction, (iv) engineering, etc. The User’s condition supposes the adherence to all of the Conditions of Use in the version published at the moment of entrance to the Site.
   • “The Notebook Club” has the exclusive right to modify unilaterally, at any time and without any previous notice, the presentation and configuration of the Site, as well as the right to modify or delete the services and conditions required to enter and use the Site at anytime and without any previous notice.
   • “The Notebook Club” declares through this medium that the content and use of the Site is focused and reserved only and exclusively to an audience over 18 years old.
3. CONDITIONS OF ACCESS AND USE OF THE SITE
   • Commitment to a correct use of the Site
     • The User commits to using the Site accordingly to everything enlisted in the Conditions of Use, the decency, public order and generally accepted purposes. The User commits to abstaining from using the Site’s content with illicit purposes or against these Conditions of Use, damaging to the rights and interests of third parties, or executing any conduct that in any way can damage, paralyze, overcharge or deteriorate.
   • Effects of the subscription to the Site
     • Once the User has completed the registration at the Site, “The Notebook Club”, besides publishing the content referred in these Conditions of Use, will send the User a monthly selection of notes of interest. The User will be able to have access to all the rewards that “The Notebook Club” publishes periodically in the Site, that may include, among others, Amazon gift cards.
   • Correct use of the Contents by the User
     • The User must abstain from obtaining or intending to obtain information, messages, graphics, drawings, images, photographs, software or any kind of material or content that is available through the Site by using different procedures or means from those available to them or indicated in the Site.
     • The User commits to using the content published in the Site in a diligent, correct and legal way, The User commits specially to abstaining from:
   • Using the Content with illegal purposes or effects, as well as those purposes against the law, decency and generally publicly accepted purposes.
     • Reproducing, copying, distributing, or granting access through any public communication modality. Transforming or modifying the content, unless they have the right holder’s authorization.
     • Suppressing, eluding or manipulating the intellectual or industrial right properties of “The Notebook Club”, as well as any brand owner, as well as identifying data, The Notebook Club’s right, or any of the agents that appear in the contents, as well as the technical protection devices, fingerprints or any information mechanisms that may obtain the content.
     • Using the content and, particularly, any information obtained through the Site to share advertisements, communications with direct sale purposes or any other commercial purpose, unsolicited messages directed to communities no matter their purpose, as well as commercializing or distributing such information.
     • Executing any action against the personal data protection regulation norms, as well as Intellectual and/or Industrial Property.
     • The User’s violation of any of these commitments will cause the corresponding legal consequences.
   • Password use: Custody Duty
     • In case of completing the registration, and in those areas where “The Notebook Club” requires identification through username and password, the User commits to a diligent and private use of the assigned password and username for the access to the Site.
     • The User will respond to expenses and damage caused by their use of content published by “The Notebook Club” in the Site by any third party using their password and username due to a non diligent use or loss by the User.
   • Commitment to observe the instructions
     • The User commits to observe closely and diligently any instruction by “The Notebook Club” or by authorized personnel relative to the Site’s use.
   • Responsibility in case of damage
     • The User is responsible for all damage (present, probable and alleged) of all kinds that “The Notebook Club” may suffer as consequence of the violation of any of the obligations described in this document.
   • “The Notebook Club” reserves the right of executing legal actions in case it is necessary.
4. PERSONAL DATA
   • All the information related to the use of personal data is gathered and explained in the Privacy Policy published in the Site’s footer.
5. COOKIES
   • The User that enters the Site agrees to receive the cookies transported by the www.the-notebookclub.com server. “Cookie” refers to a data file that is saved in the User’s computer hard disk when they enter the Site. The Cookies may contain information like the User’s identification, or information to track the pages that the User has visited. A cookie cannot read data or information from the User’s hard disk, nor the Cookies created by other sites or pages. The use of these cookies will not have the purpose of identifying the Users, except in case of investigation of alleged fraud.
6.  GUARANTEE AND RESPONSIBILITY EXCLUSION
   • Guarantee and responsibility exclusion for the Site’s function.
     • Availability and continuity: “The Notebook Club” doesn’t guarantee the availability and continuity of the Site’s function. It also excludes any responsibility of damage of all kind that can be related to the lack of availability or continuity of the Site’s function. 
     • Usefulness: “The Notebook Club” does not guarantee that the Site is useful for any particular activity.
     • Reliability: “The Notebook Club” does guarantee the site’s reliability, however and particularly but not exclusively, it does not guarantee that Users can, through the Site’s use, distribute, gather or transmit to third parties the content, as well as receiving access or obtaining the content.
   • Guarantee and responsibility exclusion for content hosted out of the Site.
     • “The Notebook Club” makes technical connection devices available (such as links, banners and buttons), directories and search tools that let Users have access to websites owned by third parties (throughout this document, referred to as Linked Sites). The installation of these links, directories and search tools in the Site has the sole purpose of facilitating Users in the search and access to information that is available online. This doesn’t imply any sort of relationship or partnership between “The Notebook Club” and the owners of the Linked Sites.
     • “The Notebook Club” doesn’t previously control, approve nor own the services, information, data, files, products and any kind of material existing in the Linked Sites. The User, therefore, must be extremely prudent in the evaluation and use of the services, information, data, files, products and any kind of material hosted in the Linked Sites.
   • Guarantee and responsibility exclusion for the Site’s use
     • “The Notebook Club” does not control the access nor the use that Users make of the Site and the existing content. Particularly, “The Notebook Club” does not guarantee that the Users use the Site and the content according to the law, to these Conditions of Use and, in special cases, the Particular Conditions that result from the use, morals, decency and generally accepted conducts for the public good, or the diligent and prudence.
   •  Identity and information related to the Users provided by the Users
     • “The Notebook Club” does not control or offer any kind of guarantee over the User’s identity, nor over the veracity, currency or authenticity of the data provided by the Users about themselves to the Site or to other Users.
   • “The Notebook Club” excludes any responsibility for damages of all kind that can be related to the wrong identity of Users and the lack of truth, currency or authenticity of the data provided by the users about themselves to the Site or to other Users. Particularly, though not exclusively, for the damage of all sorts that can be related to identity theft of third parties executed by any User in any kind of interaction through the Site.
7.  CONFIDENTIALITY
   • “The Notebook Club” commits to guarding all the User’s information as confidential according to Mexican law. “The Notebook Club” does not assume any obligation of guarding any other data that the User may provide by entering the Site, including the information that the User may provide as well as the information that “The Notebook Club” may gather through the Cookies described in the Section 5 of this document.
   • Because the User’s personal data’s security is a priority for “The Notebook Club”, there are measures that are taken in order to protect this information through different controls, as well as the capacitation for the correct management of this information.
8. USE OF NON CONFIDENTIAL DATA
   • By using the Site, the User authorizes “The Notebook Club” to use, publish, reproduce, distribute and publish non confidential informations, according to article 109 of the Mexican Author’s Rights Federal Law and fraction I, of article 76 bis in the Federal Law for Consumer Protection.
9. NO LICENSE
   • “The Notebook Club” authorizes the User to use the intellectual and industrial property rights as well as the company secrets related to the software installed in its equipment only for the Site’s use, according to the conditions established throughout this document. “The Notebook Club” does not grant any other license or authorization for use of any kind over the industrial and intellectual property rights, company secrets or any right or property related to the Site and the content published.
10. VETO AND SITE ACCESS RIGHTS WITHDRAWAL  
    • “The Notebook Club” reserves the right to refuse or withdraw the access rights to the Site at any time and without any previous notice, by the company’s initiative or due to a third party’s request, to those Users that violate these Conditions of Use and the Particular Conditions that may result in each case.
11. INTELLECTUAL OR INDUSTRIAL PROPERTY RIGHTS
    • “The Notebook Club” holds all rights over the Site’s content, design and source code, particularly but not exclusively the photographs, images, text, logos, designs, brands, commercial names and data.
    • The User is noticed that such rights are protected by the current Mexican law related to intellectual and industrial property.
    • The Site’s content also includes the computer program, therefore, it is also protected by all the Mexican and international legislation around the issue.
    • The site’s complete or partial reproduction is expressly forbidden, even through an hyperlink, as well as any of its content, without previous written permission extended by “The Notebook Club”.
    • The copy, reproduction, adaptation, modification, distribution, commercialization, public communication or any other action that involves a violation of the current Mexican and/or international legislation in intellectual or industrial property matters, as well as the Site’s content use, without previous written permission extended by “The Notebook Club”.
    • “The Notebook Club” notifies that the sole access and consultation of the Site does not grant any license, authorization or implicit rights over any intellectual and/or industrial property rights, nor any other related rights or property, directly or indirectly, over content showcased and published in the Site.
12. ADDITIONAL TERMS
    • From time to time, “The Notebook Club” may include additional provisions related to specific areas or new promotions to the Site’s Conditions of Use (from this point on, referred to as “Additional Terms”). These terms will be published through the Site. The Additional Terms are part of the Conditions of use for all legal effects.
13. MODIFICATIONS TO GENERAL CONDITIONS OF USE
    • “The Notebook Club” withholds the right to modify, at any given time, the Site’s presentation and configuration, as well as the Conditions of Use. Therefore, “The Notebook Club” advises the User to read them carefully every time they enter the Site. The Users must dispose these Conditions in a visible site, with free access for every visit. The acceptance of these General Conditions of Use will always be a previous and mandatory step for the entrance to the Site.
    • Every time the User enters the Site will be considered as an absolute acceptance to any modification.
14. NULLITY
    • In case of the declaration of nullity of any section within these Conditions of Use, the remaining sections will stay current and subject to interpretation considering the parties’ will and the Conditions’ purpose. “The Notebook Club” may refuse to execute any right or faculty described in this document, action that does not imply, in any way, the resignation to them unless there is an explicit declaration by “The Notebook Club” or an action prescription that may apply.
15. JURISDICTION AND APPLICABLE LAW
    • For interpretation, fulfillment and execution of these General Conditions of Use, the parties agree to abide to the  Mexican Federal Law and Mexico City qualified tribunals, resigning to any other jurisdiction that may apply depending on future or present addresses.

CONDICIONES GENERALES DE USO​

1. ALCANCE Y ACEPTACIÓN

Las presentes Condiciones de Uso (en adelante, las “Condiciones de Uso”) regulan el uso del Sitio Web www.the-notebookclub.com (el “Sitio”) responsabilidad de Soluciones Administrativas Kosheleva SA de CV. (en adelante, “The Notebook Club”), compañía de nacionalidad mexicana con domicilio en Av. Antonio de Mendoza Número 323 Int: E, Colonia Lomas de Chapultepec IV Sección, CP 11000, Miguel Hidalgo, Ciudad de México, México y correo electrónico contacto@dinamcg.com

La utilización del “Sitio” atribuye la condición de usuario y expresa la conformidad plena y sin reservas del Usuario a todas y cada una de las Condiciones de Uso, con respecto a la versión publicada en el momento de acceso del Usuario. Por ello, se sugiere al Usuario que lea detenidamente el contenido de las presentes Condiciones de Uso. En caso de contradicción entre las Condiciones de Uso y las Condiciones particulares que, en su caso, se establezcan, prevalecerá lo dispuesto en estas últimas.

2. OBJETO

A través del “Sitio”, “The Notebook Club” facilita a los Usuarios el acceso a diversos contenidos puestos a disposición en el “Sitio”.

Al ingresar al “Sitio”, el Usuario acepta todas las Condiciones de Uso, establecidas por “The Notebook Club” y, en consecuencia, estará obligado por estas Condiciones de uso. El Usuario acepta todas las Condiciones de uso establecidas por el “Sitio»; de no encontrar satisfactorios las Condiciones que se establecen a continuación, por favor hacer clic en “NO ACEPTO” o abstenerse de ingresar al “Sitio”.

• • • • • • • El Usuario es legalmente capaz y cuenta con las facultades mentales y físicas para decidir, obligarse y utilizar el “Sitio” bajo los términos descritos; en su defecto, el Usuario manifiesta expresamente al aceptar estas Condiciones de Uso.
            • El Usuario acepta que ingresa al “Sitio”, bajo su completa autonomía de voluntad y en pleno uso de sus facultades mentales.
            • La vigencia de las Condiciones de Uso que lo componen comenzará a partir del momento en que el Usuario ingrese al “Sitio” y se registre.
            • El Usuario es libre de ingresar al “Sitio” cuantas veces quiera, sin perjuicio que “The Notebook Club”, en uso de las facultades otorgadas por medio de la aceptación de estas Condiciones de Uso, determine excluir al Usuario bajo los parámetros que más adelante se establecen.
            • Las imágenes, marcas, símbolos, sonidos, nombres y/o cualquier contenido incluido en el material transmitido a través del Sitio, se entenderá que contiene derechos de propiedad intelectual y son propiedad exclusiva de “The Notebook Club”, por lo cual la anterior disposición les será aplicable respecto a su utilización, y así lo acepta el Usuario.
            • “The Notebook Club” no es directamente responsable por los contenidos publicados en el “Sitio”. El usuario acepta esta advertencia y se abstendrá de tomar cualquier tipo de represalia en contra de “The Notebook Club” si algún contenido llegase a atentar contra su integridad moral, creencias políticas/religiosas, o convicciones personales.
            • “The Notebook Club” se reserva el derecho de admisión y la autonomía de negar, prohibir o vetar el ingreso al “Sitio” a cualquier Usuario, por uso indebido del mismo, que no esté acorde con la ley o las Condiciones de Uso referidas. De ser vetado, el Usuario aceptará tal decisión sin que se acepte reclamaciones ni habrá lugar a ningún tipo de indemnización.

“The Notebook Club” mediante el registro a través de su “Sitio”, proporciona acceso a contenido informativo en los siguientes temas: (i) arquitectura, (ii) diseño, (iii) construcción, (iv) ingeniería, etc.; la condición de Usuario supone la adhesión por parte de éste a las Condiciones de uso en la versión publicada en el momento en que se acceda al “Sitio”.

“The Notebook Club”, se reserva el derecho a modificar unilateralmente, en cualquier momento y sin aviso previo, la presentación y configuración del “Sitio”, así como también se reserva el derecho a modificar o eliminar, en cualquier momento y sin previo aviso, los servicios y las condiciones requeridas para acceder y/o utilizar el “Sitio”.

“The Notebook Club” por este medio hace del conocimiento de los Usuarios que el contenido y uso del “Sitio” está reservado y dirigido única y exclusivamente a un público mayor de 18 años.

3. CONDICIONES DE ACCESO Y UTILIZACIÓN DEL “SITIO” 

• • • • Obligación de hacer un uso correcto del “Sitio”
        • El Usuario se compromete a utilizar el “Sitio” de conformidad con lo dispuesto en estas Condiciones de Uso, las buenas costumbres, el orden público, y los usos generalmente aceptados, y se obliga a abstenerse de utilizar el contenido existente en el Sitio con fines o efectos ilícitos, contrarios a lo establecido en las presentes Condiciones de Uso, lesivos de los derechos e intereses y la imagen de terceros, o que de cualquier forma puedan dañar, inutilizar, sobrecargar o deteriorar.
      • Efectos de la suscripción al “Sitio”
        • Una vez que el Usuario se haya registrado en el “Sitio”, “The Notebook Club” además de publicar el contenido referido en estas Condiciones de Uso, enviará al Usuario de manera mensual una selección de notas de su interés, además el Usuario podrá tener acceso a todas las recompensas que de tiempo en tiempo publique “The Notebook Club” en el “Sitio”, las cuales podrán incluir entre otras, tarjetas de regalo Amazon o cualquiera otra que “The Notebook Club” especifique.
      • Uso correcto de los Contenidos por el Usuario
        • El Usuario deberá abstenerse de obtener o tratar de obtener informaciones, mensajes, gráficos, dibujos, imágenes, fotografías, software y, en general, cualquier clase de material o contenido accesible a través del “Sitio” empleando para ello medios o procedimientos distintos de los que, según los casos, se hayan puesto a su disposición a este efecto o se hayan indicado a este efecto en el “Sitio” en que se encuentren los Contenidos, siempre que no entrañen un riesgo de daño o inutilización del “Sitio” y de los Contenidos publicados en él.
      • El Usuario se obliga a usar los Contenidos publicados en el “Sitio” de forma diligente, correcta y lícita y, en particular, se compromete a abstenerse de:
        • Utilizar los Contenidos de forma, con fines o efectos contrarios a la ley, las buenas costumbres y los usos generalmente aceptados o al orden público;
        • Reproducir o copiar, distribuir, permitir el acceso del público a través de cualquier modalidad de comunicación pública, transformar o modificar los Contenidos, a menos que se cuente con la autorización del titular de los correspondientes derechos o ello resulte legalmente permitido;
        • Suprimir, eludir o manipular los derechos de propiedad intelectual o industrial de “The Notebook Club”, así como de cualquier titular de marca, así como el resto de los datos identificativos o derechos de “The Notebook Club”, o de cualquiera de sus titulares que figuren en los Contenidos, así como los dispositivos técnicos de protección, las huellas digitales o cualesquiera mecanismos de información que pudieren contener los Contenidos;
        • Emplear los Contenidos y, en particular, la información de cualquier clase obtenida a través del “Sitio” para remitir publicidad, comunicaciones con fines de venta directa o con cualquier otra clase de finalidad comercial, mensajes no solicitados dirigidos a una pluralidad de personas con independencia de su finalidad, así como a abstenerse de comercializar o divulgar de cualquier modo dicha información y;
        • En especial, a realizar cualquier acto contrario a las normas que regulan la protección de datos de carácter personal, así como la Propiedad Intelectual y/o Industrial.
      • El incumplimiento por el Usuario de cualquiera de estas obligaciones llevará aparejada la acción o acciones legales oportunas.
        • Uso de la contraseña: deber de custodia.
        • En caso de proceder a registrarse, y en las áreas en que “The Notebook Club” requiera la identificación a través de nombre de usuario y contraseña, el Usuario se compromete a hacer un uso diligente y a mantener en secreto la contraseña y nombre de usuario asignado, en su caso, para acceder al “Sitio”.
        • El Usuario responderá de los gastos y de los daños y perjuicios ocasionados por la utilización de los Contenidos publicados “The Notebook Club” en el “Sitio”, por cualquier tercero que emplee al efecto su contraseña y nombre de usuario debido a una utilización no diligente o a la pérdida de estos por el Usuario.
        • 3.5. Obligación de observar las instrucciones
        • El Usuario se compromete a observar diligente y fielmente cualquier instrucción impartida por “The Notebook Club”, o por personal autorizado por esta, relativa al uso del “Sitio”.
        • 3.6. Responsabilidad por daños y perjuicios
        • El Usuario responderá de todos y cada uno de los daños (presentes, probables y presumibles) y perjuicios de toda naturaleza que “The Notebook Club” pueda sufrir como consecuencia de incumplimiento de cualquiera de las obligaciones a las que queda sometido por las Condiciones de Uso aquí establecidas.
        • “The Notebook Club” se reserva el derecho de iniciar las acciones legales que en derecho le pudieran asistir.

4. DATOS DE CARÁCTER PERSONAL

Toda la información sobre el tratamiento de datos de carácter personal está recogida y detallada en la Política de Privacidad publicada en el footer del “Sitio”.

5. COOKIES

El Usuario que tenga acceso al “Sitio» acuerda recibir las cookies que les transmitan el servidor de www.the-notebookclub.com ”Cookie” significa un archivo de datos que se almacena en el disco duro de la computadora del Usuario cuando éste tiene acceso al “Sitio”. Las Cookies pueden contener información tal como la identificación proporcionada por el Usuario o información para rastrear las páginas que el Usuario ha visitado. Una Cookie no puede leer los datos o información del disco duro del Usuario ni leer las Cookies creadas por otros sitios o páginas. La utilización de cookies no será utilizada para identificar a los Usuarios, a excepción de los casos en que se investiguen posibles actividades fraudulentas.

6. EXCLUSIÓN DE GARANTÍAS Y DE RESPONSABILIDAD

Asimismo, excluye cualquier responsabilidad por los daños y perjuicios de toda naturaleza que puedan deberse a la falta de disponibilidad o de continuidad del funcionamiento del “Sitio”.
          • Utilidad: “The Notebook Club” no garantiza que el “Sitio” sea útil para la realización de ninguna actividad en particular.
          • Fiabilidad: “The Notebook Club” garantiza la fiabilidad del “Sitio”, sin embargo; y en particular, aunque no de modo exclusivo, no garantiza que los Usuarios puedan a través del “Sitio” transmitir, difundir, almacenar o poner a disposición de terceros los Contenidos, o recibir, obtener o acceder a los Contenidos.

• • • • • 6.2. Exclusión de garantías y de responsabilidad por los contenidos alojados fuera del “Sitio”
          • “The Notebook Club” pone a disposición de los Usuarios dispositivos técnicos de enlace (tales como, entre otros, links, banners, botones), directorios y herramientas de búsqueda que permiten a los Usuarios acceder a sitios web pertenecientes a terceros (en adelante, «Sitios Enlazados»). La instalación de estos enlaces, directorios y herramientas de búsqueda en el Sitio tiene por único objeto facilitar a los Usuarios la búsqueda de y acceso a la información disponible en Internet, y no presupone que exista ninguna clase de vínculo o asociación entre “The Notebook Club” y los operadores de los Sitios Enlazados.
          • “The Notebook Club” no controla previamente, aprueba ni hace propios los servicios, información, datos, archivos, productos y cualquier clase de material existente en los Sitios Enlazados. El Usuario, por tanto, debe extremar la prudencia en la valoración y utilización de los servicios, información, datos, archivos, productos y cualquier clase de material existente en los Sitios Enlazados.
        • 6.3. Exclusión de garantías y de responsabilidad por la utilización del “Sitio”
          • “The Notebook Club” no controla el acceso ni la utilización que los Usuarios hacen del “Sitio” y de los Contenidos existentes. En particular, “The Notebook Club” no garantiza que los Usuarios utilicen el “Sitio” y los Contenidos de conformidad con la ley, estas Condiciones de Uso y, en su caso, las Condiciones Particulares que resulten de aplicación, la moral y buenas costumbres generalmente aceptadas y el orden público, ni que lo hagan de forma diligente y prudente.
        • 6.4. Identidad e información relativa a los Usuarios proporcionada por los propios Usuarios
          • “The Notebook Club” no controla ni ofrece ninguna clase de garantía sobre la identidad de los Usuarios, ni sobre la veracidad, vigencia, exhaustividad y/o autenticidad de los datos que los Usuarios proporcionan sobre sí mismos y proporcionan o hacen accesibles para otros Usuarios.
        • “The Notebook Club” excluye cualquier responsabilidad por los daños y perjuicios de toda naturaleza que puedan deberse a la incorrecta identidad de los Usuarios y a la falta de veracidad, vigencia, exhaustividad y/o autenticidad de la información que los Usuarios proporcionan acerca de sí mismos y proporcionan o hacen accesibles para otros Usuarios, y en particular, aunque no de forma exclusiva, por los daños y perjuicios de toda naturaleza que puedan deberse a la suplantación de la personalidad de un tercero efectuada por un Usuario en cualquier clase de comunicación realizada a través del Sitio.

7. CONFIDENCIALIDAD

“The Notebook Club” se obliga a mantener confidencial la información que reciba del Usuario que tenga dicho carácter conforme a las disposiciones legales aplicables en los Estados Unidos Mexicanos. “The Notebook Club” no asume ninguna obligación de mantener confidencial cualquier otra información que el Usuario le proporcione, ya sea al ingresar al “Sitio”, incluyendo aquella información que el Usuario proporcione, así como la información que obtenga “The Notebook Club” a través de las Cookies que se describen en la sección 5 de estas Condiciones de Uso.

En virtud de que la seguridad de la información personal del Usuario es una prioridad para “The Notebook Club”, se toman medidas para proteger esta información mediante el establecimiento de distintos controles, así como la capacitación en el manejo adecuado de esta información.

8. USO DE LA INFORMACIÓN NO CONFIDENCIAL

Mediante el uso del “Sitio”, el Usuario autoriza a “The Notebook Club” a utilizar, publicar, reproducir, divulgar, comunicar públicamente y transmitir la información no confidencial, en términos de lo establecido en el artículo 109 de la Ley Federal de los Derechos de Autor y de la fracción I, del artículo 76 bis de la Ley Federal de Protección al Consumidor. 

9. NO LICENCIA

“The Notebook Club” autoriza al Usuario la utilización de los derechos de propiedad intelectual e industrial y de los secretos empresariales relativos al Software instalado en su equipo informático únicamente para utilizar el “Sitio”, de conformidad con lo establecido en estas Condiciones de Uso. “The Notebook Club” no concede ninguna otra licencia o autorización de uso de ninguna clase sobre sus derechos de propiedad industrial e intelectual, secretos empresariales o sobre cualquier otra propiedad o derecho relacionado con el “Sitio” y los contenidos que se publiquen.

10. DENEGACIÓN Y RETIRADA DEL ACCESO AL SITIO.

“The Notebook Club” se reserva el derecho a denegar o retirar el acceso al Sitio, en cualquier momento y sin necesidad de preaviso, por iniciativa propia o a instancia de un tercero, a aquellos Usuarios que incumplan estas Condiciones de Uso y, en su caso, las Condiciones Particulares que resulten de aplicación.

11. DERECHOS DE PROPIEDAD INTELECTUAL O INDUSTRIAL

“The Notebook Club” ostenta todos los derechos sobre el contenido, diseño y código fuente tanto del Sitio y, en especial, con carácter enunciativo, pero no limitativo, sobre las fotografías, imágenes, textos, logos, diseños, marcas, nombres comerciales y datos que se incluyen en el mismo.

Se señala al Usuario que tales derechos están protegidos por la legislación vigente mexicana relativa a la propiedad intelectual e industrial.

Asimismo, y sin perjuicio de lo anterior, el contenido del “Sitio” también tiene la consideración de programa informático y, por lo tanto, le resulta también de aplicación toda la normativa mexicana e internacional vigente en la materia.

Queda expresamente prohibida la reproducción total o parcial del “Sitio”, ni siquiera mediante un hiperenlace, ni de cualquiera de sus contenidos, sin el previo permiso expreso y por escrito de “The Notebook Club”.

Asimismo, queda totalmente prohibida la copia, reproducción, adaptación, modificación, distribución, comercialización, comunicación pública y/o cualquier otra acción que comporte una infracción de la legislación vigente mexicana y/o internacional en materia de propiedad intelectual y/o industrial, así como el uso de los contenidos del “Sitio” si no es con previa autorización expresa y por escrito de “The Notebook Club”.

“The Notebook Club” informa que el solo hecho de acceder y consultar el “Sitio” no concede licencia, autorización o derecho implícito alguno sobre los derechos de propiedad intelectual y/o industrial o sobre cualquier otro derecho o propiedad relacionado, directa o indirectamente, con los contenidos incluidos y publicados en el “Sitio”.

12. TÉRMINOS ADICIONALES

Ocasionalmente, “The Notebook Club” podrá agregar a las Condiciones de Uso, provisiones adicionales relativas a áreas específicas o nuevas promociones que sean proporcionados a través del “Sitio” (en lo sucesivo “términos adicionales”), los cuales serán publicados en el “Sitio”. Los términos adicionales forman parte integrante de las Condiciones de Uso para todos los efectos legales a que haya lugar.

13. MODIFICACIÓN DE LAS CONDICIONES GENERALES DE USO

“The Notebook Club” se reserva el derecho de modificar, en cualquier momento, la presentación y configuración del “Sitio”, así como las Condiciones de Uso. Por ello, “The Notebook Club” recomienda al Usuario leerlas atentamente cada vez que acceda al Sitio, los Usuarios deberán disponer de estas Condiciones de Uso en un sitio visible, libremente accesible para cuantas consultas quiera realizar. En cualquier caso, la aceptación de las Condiciones generales de uso será un paso previo e indispensable al ingreso al “Sitio”. 

No obstante, lo anterior cada vez que el Usuario acceda al “Sitio”, se considerará como una aceptación tácita absoluta a las modificaciones realizadas.

14. NULIDAD

En caso de que cualquier sección de las Condiciones de Uso, sea declarada nula, las demás secciones seguirán vigentes y se interpretarán teniendo en cuenta la voluntad de las partes y la finalidad misma de las Condiciones de Uso. “The Notebook Club” podrá no ejercer alguno de los derechos y facultades conferidos en este documento lo que no implicará en ningún caso la renuncia a los mismos salvo reconocimiento expreso por parte de “The Notebook Club” o prescripción de la acción que en cada caso corresponda.

15. LEYES APLICABLES Y JURISDICCIÓN

Para la interpretación, cumplimiento y ejecución de las Condiciones generales de uso, las partes están de acuerdo en que serán aplicables las leyes Federales de los Estados Unidos Mexicanos y competentes los tribunales de la Ciudad de México, renunciando expresamente a cualquier otro fuero o jurisdicción que pudiera corresponderles, en razón de sus domicilios presentes o futuros.
